Agreement Overview
These Terms of Use and Service (the "Agreement") represent a contract between ExamReady OÜ, located at Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-201, 10152, and any individual using the NCLEX 2025 Exam Prep platform (the "Website" or "we"). By accessing or using the Website, you agree to comply with all terms set forth in this Agreement. If you disagree with any term, please discontinue use immediately.
IMPORTANT: THIS AGREEMENT INCLUDES A BINDING ARBITRATION CLAUSE IN SECTION 12, AFFECTING YOUR LEGAL RIGHTS. IT ALSO INCLUDES DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, AND A CLASS ACTION WAIVER.
1. Services Provided
ExamReady OÜ grants you access to digital services and content (the "Service"). Account creation may be required.
2. License and Restrictions
You are granted a limited, non-exclusive, non-transferable license to access and use the Website for personal purposes only.
Restrictions
You may not:
Copy, distribute, modify, or publicly display any part of the Website or its content.
Disrupt Website servers or networks.
Use automated systems to access the Website.
Bypass security measures of the Website.
3. Intellectual Property

You acknowledge that the Website and its licensors retain all rights, titles, and interests in the Website, including intellectual property rights.

By submitting User Submissions, you grant ExamReady OÜ a perpetual, non-exclusive license to use, reproduce, and distribute your submissions.
5. Payment Terms
5.1 Subscription
Using the Service requires a subscription. By subscribing, you agree to recurring charges until cancellation. Subscription renews automatically unless canceled.
5.2 Refunds
Refunds are provided as per our Money-Back Guarantee policy.
5.3 Cancellation
To cancel, contact customer support at support@examready.pro. Responsibilities for any charges up to the cancellation date remain with you.
6. Privacy
Your personal information is governed by our Privacy Policy, which outlines our data collection and use practices.
7. Account Termination
ExamReady OÜ reserves the right to suspend or terminate accounts for any reason, including inactivity or violation of these Terms. Users may also request account termination via customer support.
8. Copyright Policy
8.1 Reporting Infringements

8.2 False Notifications
ExamReady OÜ may seek damages for false infringement notifications.
9. Disclaimers of Warranties
The Website is provided "AS IS." ExamReady OÜ disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose. Use of the Website is at your own risk.
10. Limitation of Liability
ExamReady OÜ is not liable for any damages arising from your use of the Website. Liability is limited to the greater of the fees paid by you or $100.
11. Indemnity
You agree to indemnify ExamReady OÜ against any claims arising from your use of the Website in violation of this Agreement.
12. Dispute Resolution and Arbitration

This Agreement remains in effect while you use the Website. Certain sections survive termination.

16. Miscellaneous
16.1 Governing Law
This Agreement is governed by the laws of Estonia.
16.2 Entire Agreement
This Agreement constitutes the entire agreement between you and ExamReady OÜ.
16.3 No Waiver
Failure to enforce any part of this Agreement does not waive our right to enforce it later.
16.4 Force Majeure
ExamReady OÜ is not liable for failure to perform due to causes beyond its control.
